Brief description of the most interesting legal acts which have been included into
the National Register of Legal Acts of the Republic of Belarus within the last week.

The Decision of the Council of Ministers of the Republic of Belarus of October 17, 2003 No. 1335 On Approving the Regulation on Licensing of the Activity Connected with Attracting Foreign Labor Force to the Republic of Belarus and Employment of Citizens of the Republic of Belarus Abroad approved the mentioned Regulation. According to it applicants for obtaining the license for the activity connected with employment of citizens of the Republic of Belarus abroad are only legal persons and individual entrepreneurs of the Republic of Belarus. Applicants for obtaining the license for the activity connected with attracting foreign labor force to the Republic of Belarus are legal persons and individual entrepreneurs of the Republic of Belarus as well as foreign legal persons fully or partially carrying out their activity on the territory of the Republic of Belarus. The Regulation approves the documents needed for these licenses and reasons for their annulment, in particular the license can be annulled by the Ministry of Labor and Social Security for sever violations legislation on licensing or violation of the established requirements and conditions for fulfillment of such activity.

 

The Decision of the Council of Ministers of the Republic of Belarus of October 17, 2003 No. 1349 approves the Regulation on Licensing of the Activity Connected with Turnover (Except for Retail Trade) of Alcohol, Non-Food Alcohol Containing Products, Ethyl Alcohol and Tobacco Goods. The license is issued by the Oblast executive committees and Minsk City Executive Committee at the place of location of legal person or individual entrepreneur. The Regulation establishes the documents needed for obtaining the license and license requirements and conditions.

 

The Decision of the Council of Ministers of the Republic of Belarus No. 1350 of October 17, 2003 approves the Regulations on Licensing of Retail Trade (Including Alcohol Drinks and Tobacco Goods) and Public Catering. According to Regulation the licensing is carried out by the Minsk City Executive Committee, regional or town executive committees. The Regulation establishes the documents needed, requirements and conditions for obtaining the license and lists the sever violations causing the annulment of the license. In particular, sale of goods with expired date, trading for public catering in the places not established by local executive and administrative bodies, absence of the accompanying documents, non-observance of the range of goods, trade with alcohol products without excise marks, etc.

 

The Decision of the Council of Ministers of the Republic of Belarus No. 1345 of October 17, 2003 On Import of Alcohol Products and Ethyl Alcohol establishes the import to the customs territory of the Republic of Belarus of alcohol products and ethyl alcohol is carried out at presence of quotas and special permits (licenses) to the right to import such products except for transit transportation across the customs border of the Republic of Belarus. The Decision also approves the Regulation on Procedure of Establishing the Quotas for Import of Alcohol Products and Ethyl Alcohol, Regulation on Procedure of Organization and Holding Competitions for Realization of Quotas to Import Alcohol Products and Ethyl Alcohol and Regulation on Inter-Departmental Commission for Organization and Holding Competitions for Realization of Quotas to Import of Alcohol Products and Ethyl Alcohol.

 

The Ministry of Natural Resources and Protection of Environment, Ministry of Finance of the Republic of Belarus and Ministry on Taxes and Dues on October 17, 2003 passed the Decision No. 93/36/141 bringing in changes to the Instruction on Order of Calculation and Payment to the Budget of Payment for Allocation of Wastes. In particular, according to the Decision from the August 1, 2003 the payment at the amount of 6 basic values is taken for issuing to the legal persons and individual entrepreneurs of the permits for allocation of industrial wastes. Payment for issuing the duplicates of the permits is taken at the amount of 3 basic values.

 

The Decision of the Council of Ministers of the Republic of Belarus of October 17, 2003 No. 1346 approves the Regulations on Licensing of Kinds of Activity Licensing of Which is Carried Out by the Ministry of Finance. The Decision approves the Regulation on Licensing of Auditing Activity, Regulation on Licensing of Activity on Elaboration and Production of Strict Accountability Forms and Material For Their Protection Against Forgery, Regulation on Licensing of Lottery Activity and Regulation on Licensing of the Activity Connected with Precious Metals and Stones.

 

The Decision of the Ministry of Finance of October 16, 2003 No. 137 abolishes the Instruction of the Committee on Control over Activity at the Ministry of Finance of the Republic of Belarus of June 25, 1999 No.49 concerning the liability of the insurance organizations and also establishes that the fine for every day of postponement for not timely payment of insurance compensation at insurers fault or at the fault of Belarusian Bureau on Transport Insurance is taken at the amount of 0.1% to legal person and 0.5% to natural person from the sum subject to payment.
